What Can Bankruptcy Do for My Student Loans?

Can we get rid of your student loans?

Unfortunately, filing for bankruptcy does not get rid of your student loans. The United States Code establishes that student loans are not dischargeable unless the loans "impose an undue hardship" on you. The definition of undue hardship is a bit more extreme than you might think, though. Basically, it would have to be proven that you would never be able to pay these loans back over your entire life span. Essentially, you would have to demonstrate that you cannot and will never work again. As you can see, it is a little more complicated than one would hope.

We can, however, stop your lenders from garnishing your wages for student loans. A Chapter 13 Bankruptcy gives you the opportunity to avoid automatic payments from your paycheck, and even though it cannot get rid of that debt, it could allow you to make your own payments on your own terms. Student loan issues can be complicated, so it is usually best to speak directly with an attorney because it may be possible that we can provide you at least a little bit of relief.
